How to File a Bullet Proof H-1B Petition the FIRST Time

H-1B electronic registrants selected in the lottery are being notified by USCIS starting TODAY.  That means it’s time to get filing.  Complete petitions will start being accepted tomorrow and time is of the essence.

We anticipate high levels of RFEs again this year.  Even with the change of administration, specialty occupation and employer-employee relationship issues are still expected to run rampant.  These approval trends were commonplace before any attempts to codify them were made.  That means a bulletproof petition anticipates these issues:

Include added documentation supporting Specialty Occupation H-1B requirements.

If the H-1B job does not ALWAYS require a minimum or a US bachelor’s degree or higher in the field of the H-1B job in the US Department of Labor’s Occupational Outlook Handbook, additional documentation is needed.  Include a detailed breakdown of the duties and responsibilities of the job highlighting specialized skills and knowledge acquired through completion of a US bachelor’s degree program or higher.  Include documentation of past hiring practices showing the company requires a minimum of a US bachelor’s degree or higher for entrance into the position in question.  Tie it all together with an expert opinion letter from an industry professional with extensive field experience including having made hiring decisions regarding this position and supporting positions.  All of this must be included in the initial petition to prevent an RFE.

Include a complete itinerary for the duration of the H-1B visa.

This added step is a headache and a half but is essential for consulting firms and other companies that take on work on a per-project basis.  Employers now must show that there will be work for the H-1B employee for the entire H-1B visa period.  This means writing on a timeline of projects including client or customer contact information.  For H-1B employees who will be working at offsite third-party locations for any part of the three-year H-1B period, include an analysis of how the employer will be able to control the work of the H-1B employee even when they are working offsite.

H-1B Filing Season Opens NEXT WEEK!

Electronic registration for the H-1B lottery closes at noon TOMORROW March 25th Eastern Time.  Those selected will be notified starting March 31st after which they will have 90 days to file completed H-1B petitions.

Don’t use up those 90 days.  Over the past few years, we have seen up to three rounds of RFEs before visa approval.  This has delayed employee start dates and in turn delayed company workflow.  Get ready to file now and get ready to anticipate any bumps in the road to approval.

Specialty occupation RFEs have plagued applicants working borderline occupations that normally require a US bachelor’s degree or higher for entry into the position with some exceptions.  USCIS began adjudicating these cases making the exception the norm, which USCIS under the Trump administration attempted to codify.  With the change of presidential administration, it is unclear whether USCIS approval trends will change with it.  For this reason, we advise all H-1B petitioners filing for borderline occupations – particularly computer programmers – to include additional documentation to show that the job meets specialty occupation requirements.

  1. Include proof of past employer hiring practices showing that a bachelor’s degree has always been a minimum requirement for the job.
  2. Include a detailed breakdown of the duties and responsibilities of the job to show specialized skills and knowledge learned through an advanced degree program are required.

Does Your H-1B Petition Need a Credential Evaluation?

H-1B cap registration season is in full swing with USCIS accepting electronic registrations until noon Eastern Time on March 25th.  Those selected in the lottery will be notified starting March 31st and USCIS will begin accepting completed petitions the following day.  That means it’s time to identify where your case needs strengthening.

We anticipate high levels of RFEs this year, as we have seen over the past five years.  One of the most common RFE categories that has been towards the top for the better part of a decade is education.  This generally comes in three forms:

  • Degree is from outside of the United States, particularly the three-year bachelor’s degree.
  • Degree specialization is not an exact match for the H-1B job.
  • Incomplete, missing, or unaccredited college.

These are common because 1) H-1B employees have often completed their education in another country, 2) pathways through education are not always linear or traditional, and 3) employers routinely hire employees with degrees in fields related to the job because there is a high level of skill and knowledge overlap.

If you, or if your employee or client has a degree from outside of the United States – especially a three-year bachelor’s degree, incomplete college, no college, a degree from an unaccredited university, or the right degree in the wrong specialization, don’t wait for the education RFE to address the issue.  Include a credential evaluation in your initial filing that closes gaps between the education the beneficiary has, and the education the beneficiary needs for USCIS to approve the visa.

3 Steps to Prepare to File an Airtight H-1B Petition

H-1B Electronic Registration Opens in ONE WEEK!

Next Tuesday March 9th USCIS begins accepting electronic H-1B registrations at noon Eastern Time.  Registrations will be accepted through noon Eastern Time on March 25th.

What YOU need to know about registering:

  • ONE REGISTRATION PER BENEFICIARY!  If more than one registration is filed for a beneficiary all registrations for that beneficiary will be disqualified.
  • There is a $10 registration fee per beneficiary.
  • Petitioners must create a myUSCIS account to access the registration portal.
  • On March 31st USCIS will begin notifying registrants that have been selected and the following day USCIS begins accepted completed H-1B petitions.

The advanced degree cap of 20,000 H-1B visas will be selected first.  Those not selected will be incorporated into the subsequent regular cap of 65,000 visas.

While those selected will have 90 days to file the completed H-1B petition, we recommend having the completed petition ready as soon as possible.  The RFE rate is still high and we have seen as many as three rounds of RFEs before visa approval.  Make sure all answers are consistent across documents when you file.  Inconsistencies are a big red flag that triggers a scrutiny of the petition which leads to difficult RFEs.  Make sure all any weaknesses in your case are identified and fortified before you file.

Important H-1B Lottery Online Registration Information

Last year, USCIS implemented an online registration process for H-1B cap-subject petitioners to streamline the process.  Applicants register online BEFORE the lottery and if selected, then they have 90 days to file a completed H-1B petition.  This process will be repeated this year for FY2022 applicants and is likely to become the new normal. 

Here is what you need to know:

USCIS accepts online registrations starting on March 9th at noon Eastern Time.  Registration closes March 25th at noon Eastern Time.

Petitioners filing on behalf of H-1B employees must register online through USCIS.gov by creating a myUSCIS account at www.myaccount.uscis.gov/users/sign_up.  Petitioners – also known as registrants – will submit company information along with a $10 registration fee for each beneficiary.

Only submit ONE registration per BENEFICIARY.  If a beneficiary has more than one registration, they will be disqualified.

The 20,000 visa advanced degree cap will be selected first followed by the 65,000 visa regular cap.  This will give beneficiaries with advanced degrees two chances at being selected in the randomized lotteries.

On March 31, USCIS will notify registrants that they have been selected to file a complete petition.  The following day, on April 1st, USCIS will begin accepting full H-1B petitions for FY2022.

Do not hesitate to file the completed petition.  We anticipate RFE rates to be high again this year, and we have seen as many as three rounds of RFEs before visa approval.  Be sure to identify weaknesses in your case and anticipate any additional evidence or documentation you will need BEFORE you file.

USCIS Starts Accepting H-1B Online Registration MARCH 9TH!

Get your ten bucks out H-1B petitioners, because USCIS opens its online cap-subject H-1B registration portal on March 9th at noon Eastern Time.  Petitioners will be able to file electronically to be eligible for the H-1B lottery until March 25th at noon Eastern Time. 

Petitioners selected will be notified beginning March 31st and the following day USCIS will begin accepting full H-1B petitions.  Those selected will have three months to file the completed petition.

When you register online, the account will show the following status: SUBMITTED.  This means that your registration is eligible for selection.  Following the lottery, if the status is still SUBMITTED, it means your registration has not been selected, but is still eligible for selection.

Following the lottery, the status could change to SELECTED, which means you have 30 days from notification to file the completed petition.  NOT SELECTED means the petition is ineligible to file.  DENIED means that duplicate registrations were filed on behalf of one beneficiary.  Since this is in violation of registration rules, all registrations filed for said beneficiary are invalid for that fiscal year.  INVALIDATED-FAILED PAYMENT means the ten dollar fee did not go through.

The H-1B lottery will NOT be derandomized based on wage level as the Biden Administration has officially delayed implementation of the Trump Administration’s wage-based H-1B selection regulation for review.  If any changes happen, it will not impact this year’s H-1B lottery.

The regular cap of 65,000 petitions will be selected first, and then all beneficiaries with advanced degrees will get a second shot in the selection of 20,000 additional visas.  The order of these two lotteries has recently been reversed and is expected to remain in this order, as is the electronic application process.

How to Prevent Education RFEs this H-1B Filing Season

USCIS begins accepting electronic applications for H-1B cap-subject petitions NEXT MONTH.  Even though applicants do not file a completed petition until having been selected in the lottery, it is time to identify potential case weaknesses and how to fortify them before you file. 

A common and persistent issue H-1B applicants run into every year occurs when the beneficiary’s education is not a US degree earned in the exact field of the H-1B job.  Education RFEs arrive when:

  • The beneficiary has a degree earned outside of the United States, ESPECIALLY if it is a 3-year degree.
  • The degree is in a field other than the exact field of the H-1B job, even if it is related.
  • The degree is in a generalized field.
  • The beneficiary has incomplete college or no college at all.
  • The degree was earned at an unaccredited institution.

How to Prepare for H-1B Cap-Subject Filing Season

It’s nearly February, and that means the electronic application for H-1B cap-subject submissions is coming right up.  At the same time, the Biden Administration’s Chief of Staff Ronald A. Klain instituted a regulatory freeze through a memorandum.  That means Final Interim Rules restricting the employer-employee relationship and specialty occupation requirements and changing the selection process to prioritize higher wages have been put on hold for review.

The good news is that petitioners don’t have to have their full H-1B petition complete until after the H-1B lottery.  That means you can file the electronic application, pay the $10 fee, and if selected you have 90 days to file with a clearer view of the statutory landscape.

However, we recommend having the completed petition ready to file as soon as possible.  The rate of RFEs and difficult RFEs is still high, and petitioners have seen as many as three rounds of RFEs before visa approval.  This delays employee start dates and interrupts company workflow.

3 Insider Tips to Answering Difficult H-1B RFEs

When USCIS finds one problem with an H-1B RFE, they tend to find more because it triggers a scrutiny of the case.  In recent years, difficult RFEs that raise two or more issues have become more and more common, including the Triple Threat RFE and the classic Nightmare RFE.  These RFEs are virtually impossible to answer by their own guidelines in the timeline allotted.  So how can petitioners successfully answer them?

1. Read the RFE and then put it down.

DO NOT get caught up in the wording.  Understand the areas of the case that the RFE is calling into question – even if it is ALL of them – but don’t overthink it.  Make a list of the petition areas that need more evidence and documentation, but don’t get caught up in the RFE’s wording because it will paralyze your response.

2. Go back to the original H-1B eligibility requirements and USCIS approval trends.
