On of the decision-making tools in the USCIS’s toolbox is an RFE. They pull this one out when they cannot decide whether to approve your H1B petition or not based on the information provided. You can avoid receiving an RFE by submitting all of the required documentation in a clear and organized fashion the first time, but even with a tidy initial petition more and more RFEs are being issued every year.

The USCIS will issue an RFE to learn more about your work history, your past and present experience in the United States, your employer, your academic credentials, and what makes you especially qualified for your job that you stood out from the rest of the potential applicants. The USCIS may also call you in for an interview or conduct their own internal research or investigation into your case.

Some of the most common RFEs for H1B visas are regarding academic credentials. There are two reasons for this:

1) H1B visas are for jobs requiring a US bachelor’s degree or higher or its equivalent. If your degree is from abroad, it will be unclear what the US equivalent of your foreign education actual is unless you can provide a detailed evaluation.

2) In the past, simply having a degree would qualify you for an H1B visa. Recently, the USCIS is now requiring your degree exactly match your field of employ.

Both of these obstacles can be overcome with a detailed evaluation of your credentials by an authorized credential evaluation agency.
