How to Streamline Your RFE Response

The USCIS utilizes the RFE as a tool to make an informed decision on your case. You can ALSO use your RFE as a tool to make your case stronger and more clear, and boost your chances of having your H1-B visa petition approved.

Here are some things to keep in mind that will streamline your RFE response process.

First, be organized and punctual. You’re dealing with the USCIS, which is a massive bureaucracy that gets tons and tons of petitions, applications and responses for a whole lot of different things every day. To interface with the USCIS, you need to be VERY organized. Make sure to get your RFE submitted on time and in the exact with all of the documents and pieces of information included in the exact format requested. Do this and you can be almost certainly sure your RFE will end up on the right desk.

Second, remember your RFE will be read by a person, so be polite and courteous. Make your answers clear and readable, and be concise and organized. The easier you can make their job the better your chances of approval.

Finally be sure to choose the right credential evaluator. An increasing number of RFEs issued today are to clarify educational qualifications, either to assess whether applicants have degrees, licensure, and certifications equivalent to US standards, OR because the field in which the petitioner has their degree in does not EXACTLY match the field of their specialty occupation. For both of these situations, you will need a detailed evaluation from an authorized evaluator because you will need someone with the authority to convert classroom contact hours and work experience into college credit to bridge these qualification gaps.
