At a recent AILA (American Immigration Lawyers Association) conference they stated the following about the 3 year bachelor's degree for employment based immigrant visa purposes:

"For employment-based immigrant visa purposes (aka green card), the U.S. Citizenship and Immigration Services (USCIS) will not equate a three-year diploma plus a post-baccalaureate diploma as being the equivalent of a U.S. Bachelor's Degree for either EB-2 or EB-3 classification. Additionally, the USCIS does not accept a combination of academic background and work experience as being the equivalent of a U.S. Bachelor's Degree for "green card" purposes"

This means that the I-140 requires a single source degree evaluation and that you can *not* combine a 3 year degree and graduate diploma or work experience. The 3 year degree must be shown as equivalent to a US bachelor's degree.

3-Year degrees can be shown as equivalent to the US Bachelor's degree, using a professor's course by course evaluations and expanded report as well as an expert opinion letter, and a large reference file. The Indian 3-Year Bachelor’s Degree is materially identical to the UK 3-Year Bachelor’s Degree because the English set up the Indian higher education system when they occupied India. The UK 3-Year Bachelor’s degree is always accepted by USCIS (INS) as equivalent to the US Bachelor’s degree. The Indian, Pakistan, South American and Bangladesh degrees have not been well accepted. Until now. By properly and thoroughly evaluating the degree, Our clients are having success having the degree accepted. This is crucial when applying for the I-140 which does not allow for the combination of degrees or combining a degree with work experience. While we cannot guarantee acceptance as each USCIS case is treated separately we have had a good rate of success.

H1b Visa

If you have the equivalence of a US High School diploma and US bachelor's degree (12 years of primary and secondary school + 4 year bachelor's degree or 13 years of primary and secondary school + 3 years of university study at a recognized university) your evaluation will show you have the equivalence of a US bachelor's degree for immigration purposes. In addition many 3 year degrees with 12 years of primary and secondary school, such as the bologna project, are equivalent to a US bachelor's degree for immigration purposes.

If you do not have the above we can combine years of study from a master's degree, a post graduate diploma, a second bachelor's degree, or other studies, even if a degree was not completed, to show equivalence to a US bachelor's degree. NOTE: USCIS has recently made it very clear that diplomas and course work from private institutions will NOT be accepted unless they are government recognized or affiliated with a recognized/accredited university.

Or you can combine work experience to fill in the missing year(s) of study. Because USCIS have been scrutinizing credentials, all of our work + education evaluations are done by international professors and include an expert opinion letter.
